Expert witnesses are chosen by attorneys by a series of interviews that are designed to determine technical qualifications as an expert and to find any possible conflicts of interest between the expert and companies or individuals involved with the case.
After being hired it is the job of the expert to advise the attorney about the facts of the case and to prepare and read expert reports. This will prepare both the attorney and the expert for the deposition where opposing council will question the expert prior to trial. At trial the expert will offer opinions and be cross examined on the material covered.
Case histories will illustrate how an expert might serve in different types of cases: criminal, business, and patent infringement.
